Welcome to Washed. These Terms of Service (“Terms”) govern your access to and use of the Washed website, storefront, and related services (collectively, the “Site”), and any purchases you make from Washed LLC (“Washed,” “we,” “us,” or “our”). By accessing the Site or purchasing a product, you agree to these Terms.

If you do not agree, do not use the Site.

1) Eligibility & Your Account

• You must be at least 18 years old (or the age of majority in your state) to purchase from the Site.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2) Products, Pricing & Availability

• All products, descriptions, and prices are subject to change at any time without notice.

• We may limit quantities, discontinue products, or refuse any order at our sole discretion (including suspected fraud or misuse).

• We attempt to display product information accurately, but we do not warrant that product descriptions, images, or other content are error-free, complete, or current (see Section 10).

3) Orders & Payment

• By submitting an order, you authorize us (and our payment processors) to charge the full order amount, including applicable taxes and shipping.

• An order confirmation acknowledges receipt—not acceptance. We accept your order when we ship the products.

• We may cancel or refuse an order and will issue a refund if we do.

4) Shipping; Title & Risk of Loss

• We currently ship within the United States only.

• Orders are processed within 3 business days and ship from New York via multiple carriers. Rates and options are calculated at checkout based on order total and destination.

• Title and risk of loss pass to you when we deliver the products to the carrier for shipment (subject to your rights under applicable law).

• You will receive tracking information when your order ships. Delivery timelines are estimates and may be affected by carrier delays or events beyond our control.

FTC Mail Order Rule Compliance

We ship within the timeframe stated in your order confirmation (or, if no timeframe is specified, within 30 days of receiving your order). If we learn we cannot ship on time, we will send you a delay notice with either (i) a revised ship date or (ii) a statement that the ship date is unknown, plus a cost-free way to cancel and receive a prompt refund.

• If the first delay notice gives a revised ship date of 30 days or less and you do not respond, we may treat your non-response as consent to the new date.

• If the revised ship date is more than 30 days away or unknown and you do not respond, we will cancel your order and issue a prompt refund.

• If we still cannot ship by a revised date, we will send another notice; if you do not consent, we will cancel and promptly refund (typically within 7 working days, or within one billing cycle for credit card payments).

5) Returns, Refunds & Exchanges

• All sales are final. Due to the personal/hygienic nature of our products, we do not accept returns or exchanges.

• If your order arrives damaged or incorrect, email washed@goldenegg.media within 7 days of delivery with your order number and clear photos. We will repair, replace, or refund at our discretion.

• Items opened, used, or damaged after delivery are not eligible.

6) Promotions, Gift Cards & Coupons

• Promotions, discounts, and coupon codes may be subject to additional terms. Unless stated otherwise, promotions cannot be combined and are not redeemable for cash.

• We may modify or end a promotion at any time.

7) Acceptable Use

You agree not to misuse the Site, including by:

• violating any law or infringing any third-party right;

• attempting to interfere with the Site’s security or operation;

• using bots or scraping tools without our prior written consent;

• reselling or exporting products in violation of applicable law.

8) Intellectual Property; Feedback; DMCA

• The Site, including all text, graphics, logos, product designs, photos, and software, is owned by Washed or its licensors and is protected by IP laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

• If you submit ideas or feedback, you grant Washed a non-exclusive, worldwide, royalty-free right to use them without restrictions or compensation.

• Copyright concerns/DMCA: If you believe content infringes your copyright, contact washed@goldenegg.media with your contact details, a description of the work, the allegedly infringing material, and a statement under penalty of perjury that you are authorized to act.

9) Third-Party Services

The Site may link to third-party websites, apps, or services (e.g., payment processors, carriers). We are not responsible for third-party content or practices. Your use of third-party services is governed by their terms and privacy policies.

10) Errors, Inaccuracies & Availability

Occasionally, there may be information on the Site that contains typographical errors, inaccuracies, or omissions (including in product descriptions, pricing, and availability). We reserve the right to correct errors, change or update information, or cancel orders if any information on the Site is inaccurate, at any time and without prior notice.

11) Disclaimer of Warranties

Except as expressly stated in writing by us, the Site and all products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some states do not allow limitations on implied warranties; if so, the above may not apply to you to that extent.

12) Limitation of Liability

To the fullest extent permitted by law, Washed and its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Site or purchase/use of any product.
Our total liability for any claim related to a purchase is limited to the amount you paid for that order. Some states do not allow certain limitations; if so, the above may not apply to you to that extent.

13) Indemnification

You agree to indemnify, defend, and hold harmless Washed and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or your misuse of the Site.

14) Governing Law & Dispute Resolution

Any dispute or claim arising from your use of this site or purchase of our products will be resolved through binding arbitration rather than in court, except that you may bring qualifying claims in small-claims court.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court with jurisdiction.

You and Washed agree to waive any right to a jury trial and to bring claims only on an individual basis—not as part of a class, collective, or representative action.

You may opt out of this arbitration agreement within 30 days of accepting these Terms by emailing washed@goldenegg.media with subject line “Arbitration Opt-Out.”

This section is governed by the Federal Arbitration Act and survives termination of these Terms.

15) Changes to the Terms

We may update these Terms from time to time. The “Effective date” above reflects the latest version. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
